TERMS OF USE - DRAWING APP FOR IPAD
Welcome to Drawing App for iPad! This application ("App") is owned and operated by Bohdan Hlushko ("Developer"), who can be reached at hello@multumgrp.com. By downloading or using this App, you agree to these Terms of Use ("Terms").
USE OF APP
The App is designed for use on an iPad and is intended to be used as a tool for drawing and creating digital artwork. By using this App, you agree to use it only for its intended purpose and not for any unlawful or unauthorized purpose.

CONTENT SUBMITTED BY USERS
The App allows users to submit their own digital artwork ("User Content"). By submitting User Content to the App, you grant the Developer a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, copy, modify, create derivative works based on, distribute, publicly display, publicly perform, and otherwise exploit in any manner such User Content in all formats and distribution channels now known or hereafter devised (including in connection with the App and Developer's business and on third-party sites and services), without further notice to or consent from you, and without the requirement of payment to you or any other person or entity.
You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to use and authorize the Developer to use your User Content in the manner contemplated in these Terms.

INTELLECTUAL PROPERTY
The Developer owns all rights, title, and interest in and to the App, including all intellectual property rights. You acknowledge that the App and its contents, including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof, are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

DISCLAIMER OF WARRANTIES
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. THE DEVELOPER DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE APP OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. THE DEVELOPER DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE USE OF THE APP IN TERMS OF ITS CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE. YOU ASSUME ALL RISK FOR ANY DAMAGE TO YOUR IPAD OR LOSS OF DATA THAT RESULTS FROM YOUR USE OF THE APP.

LIMITATION OF LIABILITY
IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF THE DEVELOPER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP. THE DEVELOPER'S LIABILITY SHALL NOT EXCEED THE AMOUNT PAID, IF ANY, BY YOU TO THE DEVELOPER FOR THE APP.

INDEMNIFICATION
You agree to indemnify, defend, and hold harmless the Developer and its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your use of the App, your User Content, or your violation of these Terms.

TERMINATION
The Developer may terminate your access to and use of the App at any time without notice if you violate these Terms or for any other reason. Upon termination, you must cease all use of the App and delete it from your iPad.

CHANGES TO TERMS
The Developer reserves the right to modify these Terms at any time without notice. Your continued use of the App following any such modification constitutes your agreement to be bound by and comply with the modified Terms.

GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the state of Manitoba, without giving effect to any choice or conflict of law provision or rule. Any legal suit, action, or proceeding arising out of or related to these Terms or the App shall be instituted exclusively in the federal or state courts located in Canada, Manitoba or Ukraine.

ENTIRE AGREEMENT
These Terms constitute the entire agreement between you and the Developer with respect to the use of the App and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and the Developer. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
